What is currently legally possible

At the federal level, the 2022 amendment to the Civil Service Act (Section 20e of the Salary Act) forms the legal basis for the use of service bicycles by federal employees and civil servants.

The regulation is expressly designed to promote ecological mobility for short distances traveled for work purposes.

Currently, two key requirements apply:

Official use
A service bicycle can only be provided if it is used primarily for official purposes. Journeys between home and work are expressly not considered official travel.
Mandatory cost sharing by the employer
Federal employees contribute 50% of the acquisition and running costs. The remaining 50% is to be covered by the employer from budgetary funds.Die Kostenbeteiligung der Bediensteten erfolgt über eine Verminderung der Bruttomonatsbezüge (Gehaltsumwandlung) und gilt als Umwandlung überkollektivvertraglich gewährter Bezüge.

Employees contribute to the costs through a reduction in their gross monthly salary (salary conversion) and this is considered a conversion of remuneration granted under collective agreements.

Classification

In several federal states, company bike leasing in the public sector is already a reality: Thanks to clear legal foundations, state and municipal employees in Oberösterreich and Vorarlberg can already lease their desired bike via salary conversion. Positive developments are also emerging in other federal states - we assume that other regions will follow soon. We recommend contacting the respective state government or responsible office to find out about the current status.

What is the situation in my state?

: In Upper Austria, company bike leasing has already been implemented on a large scale. The state of Upper Austria launched the BBG framework agreement with Lease a Bike in July 2025 and has since been offering state employees and civil servants the opportunity to lease a company bike.
In addition, company bike leasing is also enshrined in municipal service law. Cities, municipalities, and municipal associations can use the model and also implement it via the BBG framework agreement with Lease a Bike. In practice, several municipalities have already successfully made the transition.
Financing is provided through salary conversion, whereby up to 10% of gross salary can be used for the leasing rate in Upper Austria. This makes Upper Austria one of the federal states with the clearest legal basis and the broadest practical implementation.

: Company bike leasing is already a reality in Tyrol. In July 2025, the state of Tyrol initiated the BBG framework agreement with Lease a Bike, enabling state employees and civil servants to access company bikes.
The legal basis for this has been established in Tyrolean civil service law and is specified in a separate regulation. Financing is also provided through salary conversion, allowing for practical implementation in everyday working life. Together with Upper Austria, Tyrol is thus one of the pioneers in the public sector.

: In Vorarlberg, company bicycle leasing is also regulated. The state has already created a corresponding ordinance on the use of company bicycles, which gives both state and municipal employees access to them.
The regulations provide for financing through salary conversion, thus creating a legal basis for the use of bicycles as company bikes. Vorarlberg is one of the first federal states to have anchored this issue in state civil service law.

: In Burgenland, there is a legal basis for service bicycles in state service law. However, the current structure is difficult to implement in practice, as the model is mandatory for a five-year term and differs significantly from standard market conditions.
For this reason, no major implementation projects are currently known. Nevertheless, the issue is fundamentally provided for by law and offers starting points for further development of the framework conditions.

: In Vienna, company bike leasing is not yet possible in the public sector. There is currently no legal basis for this in state civil service law.
A political decision at state level would be required for implementation. Experience has shown that it is worthwhile to actively raise the issue with the state government and the relevant authorities. Lease a Bike is happy to support interested departments and decision-makers in technical discussions.
As of December 2025, there is currently no state regulation for company bike leasing in Vienna.

: In Lower Austria, too, company bike leasing is not currently planned in the public sector, as the necessary legal basis in state civil service law is lacking.
A corresponding political decision would be necessary to enable implementation. We are happy to facilitate discussions with state authorities and support the exchange of information on possible models and framework conditions.
As of December 2025, there are currently no state regulations governing company bike leasing in Lower Austria.

: In Styria, company bike leasing is not yet possible in the public sector, as there is no legal basis for it.
At the same time, the issue is already gaining political traction, which opens up opportunities for new initiatives in the medium term. Implementation therefore depends on future decisions in state civil service law. Lease a Bike is available for discussions and technical support.
As of December 2025, there is currently no state law regulating company bike leasing in Styria.

: Carinthia currently lacks the legal basis for company bike leasing in the public sector, which is why implementation is not yet possible.
However, the issue is being discussed publicly and politically and is receiving increasing political attention, which means that further steps can be expected in the near future. Lease a Bike is happy to accompany this process and provide support in the exchange of expertise with relevant authorities.
As of December 2025, there is currently no state regulation for company bike leasing in Carinthia.

: Yes, in principle, civil servants are also eligible for company bicycle leasing.
The legal basis for this was established at the federal level with the 2022 amendment to civil service law (Section 20e of the Salary Act) and by corresponding state laws.
However, the specific implementation depends on the respective civil service law (federal or state) and the internal regulations of the agency. In many cases, the framework conditions differ from those of contract employees, for example in the structure of salary conversion or formal requirements.

: A change of department or termination of employment is taken into account. Depending on the legal framework and individual situation, several options are available.
In practice, the company bicycle can be taken over at the end of or before the end of the lease, returned to the lessor, or—if legally possible—continued by the new employer.
The specific options depend on the respective service law and the contractual framework conditions. We clarify these points transparently with the respective department in advance.
: Lease a Bike is a listed partner in the e-shop of Bundesbeschaffung GmbH (BBG). BBG has already carried out the necessary procurement procedure centrally.
Public contracting authorities can therefore purchase this service directly from the existing BBG framework agreement. A separate procurement procedure is not necessary, and internal decision-making and approval processes remain unaffected.
This saves time, reduces administrative effort, and creates legal certainty.
: No. A prerequisite is always a corresponding decision by the employer and a legal basis in the respective service law. Only then can employees take advantage of the offer.

: Yes. The legal framework differs significantly.
While at the federal level (§ 20e GehG), there is a requirement for the funds to be used for work purposes and for the employer to contribute to the costs, many federal states allow for more practical models involving salary conversion.
